These Booking Terms & Conditions apply to bookings for Wholesome Bellies retreats (“Retreat”) operated by Wholesome Bellies Pty Ltd (“Wholesome Bellies”, “we”, “us” or “our”).

By paying a deposit or making any payment towards a Retreat, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1.Retreat Price & Currency

All Retreat prices are quoted in Australian dollars (AUD) unless otherwise stated.

The inclusions for each Retreat are those specifically listed on the relevant Wholesome Bellies Retreat page, itinerary or booking information.

Unless specifically stated as included, guests are responsible for their own travel to and from the Retreat, airfares, passport and visa costs where applicable, travel insurance, personal purchases, optional activities, additional meals and beverages, medical expenses and any transport outside the published Retreat arrangements.

2. Deposit & Securing Your Place

A deposit of $1,000 AUD per person is required to secure your place on the Retreat, unless a different deposit amount is specified for that particular Retreat.

Your place is not confirmed until the required deposit has been received by Wholesome Bellies.

Our Retreats are intentionally kept small and places are accepted subject to availability.

3. Payment Plans

Following payment of your deposit, the remaining Retreat balance will be paid by monthly instalments unless another payment arrangement is specified for your Retreat.

Monthly payments will generally fall due on the same calendar date each month as the date on which your deposit was paid, unless another arrangement has been agreed with Wholesome Bellies in writing.

It is your responsibility to ensure all payments are made by the relevant due dates.

If you experience difficulty meeting a scheduled payment, please contact Wholesome Bellies as soon as possible so that we can discuss the situation with you.

4. Cancellation by You

We understand that circumstances can change.

However, operating a small-group Retreat requires Wholesome Bellies to make advance commitments and payments to accommodation providers, chefs, activity providers, facilitators, transport providers and other suppliers.

If you choose to cancel your Retreat booking, you must notify Wholesome Bellies in writing.

More than five months before the Retreat

If you cancel more than five months before the scheduled start date of the Retreat, 50% of all monies paid to Wholesome Bellies at the date of cancellation will be refunded.

Any non-refundable administration fees, credit card fees or payment processing fees already incurred may be deducted from your refund.

Between five and three months before the Retreat

If you cancel between five months and three months before the scheduled start date of the Retreat, 25% of all monies paid to Wholesome Bellies at the date of cancellation will be refunded.

Any non-refundable administration fees, credit card fees or payment processing fees already incurred may be deducted from your refund.

Three months or less before the Retreat

If you cancel three months or less before the scheduled start date of the Retreat, no refund will be provided, subject always to any rights or remedies available to you under the Australian Consumer Law.

By this stage, significant Retreat costs will generally have been committed or paid to accommodation providers and other suppliers.

Comprehensive travel insurance with appropriate cancellation cover is therefore compulsory.

No refund will ordinarily be provided if you arrive late, leave the Retreat early, choose not to participate in an included activity or otherwise do not use part of the Retreat where the relevant services remain available to you.

5. Transferring Your Place to Another Person

If you are unable to attend the Retreat, you may nominate another person to take your place.

It is your responsibility to find a replacement guest.

Any transfer is subject to approval by Wholesome Bellies and any requirements or restrictions imposed by our accommodation providers or other Retreat suppliers.

Where a replacement guest is approved, they may pay Wholesome Bellies directly for the value of your booking.

Once Wholesome Bellies has received the replacement guest’s required payment in cleared funds, the payments you have made will be refunded to you in full, less any administration fees, payment processing fees, transfer fees or other reasonable costs incurred as a direct result of transferring your booking.

If a supplier does not permit a booking to be transferred, or an additional charge applies, we will advise you before the transfer is completed.

6. Travel Insurance

Comprehensive travel insurance is compulsory for every Retreat guest.

Your policy must be suitable for your personal circumstances, the Retreat destination and the activities included in the Retreat.

We recommend ensuring that your policy provides appropriate cover for matters including:

  • cancellation and interruption;
  • medical and hospital expenses;
  • emergency evacuation and repatriation where applicable;
  • personal belongings;
  • travel delays and missed connections;
  • severe weather or other travel disruption; and
  • the activities you intend to participate in during the Retreat.

You may be required to provide Wholesome Bellies with proof of appropriate travel insurance before the Retreat.

Wholesome Bellies reserves the right to decline a guest’s participation where the required travel insurance has not been obtained.

Travel insurance is a separate agreement between you and your insurer. Wholesome Bellies cannot guarantee that any particular loss, cancellation, medical event or other circumstance will be covered by your individual policy.

We encourage you to arrange your insurance as soon as your Retreat booking is confirmed so that appropriate cancellation cover is in place from the outset.

7. Travel to and From the Retreat

Unless specifically included in your Retreat package, you are responsible for arranging and paying for your own travel to and from the Retreat destination.

It is your responsibility to ensure that your flights, transfers or other travel arrangements allow enough time for you to arrive at the nominated Retreat location at the required time.

Wholesome Bellies is not responsible for the cost or consequences of cancelled flights, missed flights, delays or other disruptions caused by airlines, transport operators or other independent travel providers, except where liability cannot legally be excluded.

If you arrive after the Retreat has commenced, any additional costs involved in reaching the Retreat location will be your responsibility.

8. Passports, Visas & Entry Requirements

Where a Retreat is held outside Australia, each guest is responsible for ensuring they hold a valid passport and meet any visa, immigration, health and entry requirements that apply to their individual circumstances.

You are responsible for checking current government travel advice and entry requirements before the Retreat.

Any costs arising because a guest does not hold the required travel documents or cannot enter the Retreat destination are the responsibility of that guest.

9. Health, Fitness & Wellbeing

Our Retreats may include activities such as walking, stairs, uneven surfaces, swimming, cooking experiences, yoga or movement sessions, wellness activities, excursions, boat travel, nature-based activities and periods of transport.

You are responsible for assessing whether you are physically able to safely participate in the Retreat and its activities.

Before the Retreat, you must advise Wholesome Bellies of any health condition, mobility issue, allergy, injury, medical condition or other circumstance that may:

  • affect your ability to participate safely;
  • require special assistance;
  • affect another guest; or
  • require specific arrangements during the Retreat.

Where appropriate, you should seek your own medical advice before attending.

Your health and wellbeing remain your responsibility throughout the Retreat.

If Wholesome Bellies reasonably believes that your participation in an activity may place your health or safety, or the health or safety of another person, at significant risk, we may ask you not to participate in that activity.

10. Dietary Requirements & Food

Food is at the heart of the Wholesome Bellies experience.

Our Retreats have a strong focus on delicious, nourishing and predominantly plant-based food.

Where sustainable, appropriate to the destination or suited to the local culture, some dairy products and fish may also be offered during a Retreat.

You do not need to be vegan or vegetarian to attend a Wholesome Bellies Retreat.

Guests must notify Wholesome Bellies before the Retreat of any allergies, intolerances or specific dietary requirements.

We will make reasonable efforts to communicate these requirements to accommodation providers, chefs, restaurants and other suppliers.

However, food may be prepared by independent third-party suppliers and in shared kitchens or food preparation areas. Wholesome Bellies cannot guarantee an entirely allergen-free environment or guarantee against cross-contamination.

Guests with severe or life-threatening allergies are responsible for taking appropriate personal precautions, carrying any necessary medication and obtaining relevant medical and travel advice before attending the Retreat.

We will always make reasonable efforts to accommodate disclosed dietary requirements wherever practicable.

11. Retreat Program & Itinerary

The published program or itinerary represents our intended Retreat experience.

Sometimes circumstances require us to be flexible.

Wholesome Bellies may make reasonable changes to the order, timing, accommodation, meals, activities, facilitators, excursions, transport or other parts of the Retreat where circumstances make this necessary or where we reasonably believe a change will improve the Retreat experience.

Where practicable, we will endeavour to replace a materially changed activity, accommodation or experience with something of a similar standard or character.

Minor changes to the Retreat program do not automatically entitle a guest to a refund.

Nothing in this clause limits any rights you may have under the Australian Consumer Law.

12. Third-Party Suppliers

Some elements of our Retreats are provided by independent third parties.

These may include accommodation providers, restaurants, chefs, facilitators, guides, transport operators, wellness practitioners, activity providers and other local suppliers.

These businesses may have their own terms, operating requirements and safety procedures.

Wholesome Bellies takes reasonable care when selecting suppliers, but we do not directly control every aspect of services provided independently by those businesses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Cancellation, Postponement or Major Change by Wholesome Bellies

Wholesome Bellies reserves the right to cancel, postpone or materially change a Retreat where reasonably necessary.

If Wholesome Bellies cancels the entire Retreat and it does not proceed, guests will receive a full refund of monies paid directly to Wholesome Bellies for the Retreat, subject to any additional rights available under the Australian Consumer Law.

Unless required by law, Wholesome Bellies will not be responsible for expenses you have booked independently that do not form part of the Retreat price.

These may include airfares, additional accommodation, passports, visas, vaccinations, travel insurance, airport transfers or other personal travel arrangements.

For this reason, comprehensive travel insurance is compulsory.

14. Events Beyond Our Control

Circumstances outside our reasonable control may include severe weather, natural disasters, fire, flood, epidemic or pandemic events, border restrictions, government action, civil unrest, industrial action, transport disruption or other extraordinary events that could not reasonably have been prevented.

If an event outside our control affects a Retreat, Wholesome Bellies may make reasonable changes to the Retreat program or arrangements where necessary to protect guests or allow the Retreat to continue safely.

If the entire Retreat must be cancelled, the cancellation provisions contained within these Terms and any applicable rights under the Australian Consumer Law will apply.

15. Personal Responsibility & Participation

Participation in travel, recreational and Retreat activities inevitably involves some degree of unpredictability and risk.

By attending a Retreat, you acknowledge that activities such as walking, swimming, road transport, boat travel, cooking, wellness activities, yoga or movement sessions, excursions and nature-based activities may involve ordinary recreational or travel risks.

You agree to follow reasonable health and safety instructions provided by Wholesome Bellies, Retreat hosts, accommodation providers, facilitators, guides and activity operators.

You remain responsible for your personal decisions, behaviour, belongings and wellbeing throughout the Retreat.

Nothing in these Terms is intended to exclude or limit liability where it would be unlawful to do so.

16. Behaviour & The Retreat Experience

Wholesome Bellies is committed to creating a welcoming, inclusive, respectful and enjoyable small-group Retreat experience.

Guests are expected to behave respectfully towards fellow guests, Wholesome Bellies hosts, facilitators, accommodation staff, suppliers and others encountered during the Retreat.

Wholesome Bellies may require a guest to leave the Retreat if their behaviour is unlawful, seriously disruptive, threatening, abusive or creates a genuine risk to the health, safety or wellbeing of themselves or others.

If a guest is required to leave because of their own serious misconduct, any additional accommodation, transport or travel costs will be their responsibility.

Any entitlement to a refund will be determined in accordance with these Terms and applicable law.

17. Personal Belongings

Guests are responsible for keeping their money, luggage, electronic devices, travel documents and other personal belongings safe and secure.

We recommend using accommodation safes where available and ensuring valuable belongings are appropriately insured.

Wholesome Bellies is not responsible for loss, theft or damage to personal belongings except where responsibility arises under applicable law.

18. Photography & Video

Part of the Wholesome Bellies experience is capturing some of the beautiful moments and memories created during our Retreats.

Photographs and video may be taken during the Retreat by Wholesome Bellies, Retreat hosts, photographers or others participating in the experience.

Some of these images may be used by Wholesome Bellies for future website, social media, marketing or promotional purposes.

We respect every guest’s preference.

If you do not wish to appear in promotional photographs or video, please advise Wholesome Bellies before the Retreat or let your Retreat host know during the Retreat.

19. Privacy

Wholesome Bellies may collect personal information reasonably required to administer your booking and operate the Retreat.

This may include contact details, emergency contacts, travel information, dietary requirements, allergies and relevant health or accessibility information.

Where reasonably necessary, relevant information may be shared with accommodation providers, restaurants, chefs, facilitators, guides, transport operators or other Retreat suppliers for the purpose of providing your Retreat experience or accommodating requirements you have disclosed to us.

Personal information will otherwise be handled in accordance with applicable privacy laws and the Wholesome Bellies Privacy Policy.

20. Problems During the Retreat

If you experience a problem or concern during the Retreat, please tell your Wholesome Bellies Retreat host as soon as reasonably possible.

Giving us the opportunity to understand and address an issue while the Retreat is taking place will often allow us to resolve it quickly.

If an issue cannot be resolved during the Retreat, please provide your complaint to Wholesome Bellies in writing following the Retreat, together with sufficient information for us to investigate and respond appropriately.

21. Australian Consumer Law

These Terms & Conditions operate alongside, and do not replace, your rights under the Australian Consumer Law.Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or other protection that cannot legally be excluded, restricted or modified.

Where these Terms are inconsistent with a mandatory right or remedy available under the Australian Consumer Law, that legal right or remedy will prevail.

22. Changes to These Terms

The Terms & Conditions applying to your Retreat booking are those provided or made available to you at the time your booking is accepted.Any material amendment affecting an existing booking will be communicated to the affected guest.

23. Governing Law

These Terms & Conditions are governed by the laws of the Australian State or Territory in which Wholesome Bellies Pty Ltd carries on its relevant business operations, together with applicable Commonwealth laws.

The parties submit to the jurisdiction of the courts and tribunals having lawful jurisdiction in relation to any dispute arising from these Terms.

24. Acceptance of These Terms

By paying your deposit or otherwise confirming your Retreat booking, you acknowledge that:

  • you have read and understood these Terms & Conditions;
  • you agree to be bound by them;
  • the information you have provided to Wholesome Bellies is accurate;
  • you understand that comprehensive travel insurance is compulsory;
  • you understand the cancellation and transfer conditions applying to your booking;
  • where relevant, you are responsible for satisfying passport, visa and entry requirements; and
  • you understand that reasonable changes may occasionally need to be made to the planned Retreat program or itinerary.
