TRAVEL TOURS – BOOKING TERMS & CONDITIONS

These Booking Terms & Conditions apply to bookings for the Wholesome Bellies Travel Tour (“Tour”) operated by Wholesome Bellies Pty Ltd, ABN 97 114 973 269 (“Wholesome Bellies”, “we”, “us” or “our”).

By paying a deposit or making any payment towards the Tour, you acknowledge that you have read, understood and agree to these Terms & Conditions.


1. Tour Price & Currency

All Tour prices are quoted in Australian dollars (AUD) unless otherwise stated.

The inclusions for the Tour are those specifically listed in the relevant Wholesome Bellies Tour itinerary or booking information.

Unless expressly included in the Tour itinerary, travellers are responsible for their own international and domestic airfares, passport and visa costs, travel insurance, personal purchases, optional activities, additional meals and beverages, medical expenses and transport outside the published Tour arrangements.


2. Deposit & Securing Your Place

A deposit of $1,000 AUD per person is required to secure a place on the Tour.

Your place is not confirmed until the required deposit has been received by Wholesome Bellies.

Places are limited and bookings are accepted subject to availability.


3. Payment Plans

Following payment of your deposit, the remaining Tour balance will be paid by monthly instalments.

Monthly payments will fall due on the same calendar date each month as the date on which your deposit was paid, unless another arrangement has been agreed with Wholesome Bellies in writing.

It is the traveller’s responsibility to ensure payments are made by the relevant due dates.

If you experience difficulty meeting a scheduled payment, please contact Wholesome Bellies as soon as possible so the matter can be discussed.


4. Cancellation by You

We understand that circumstances can change. However, operating a small-group international Tour requires Wholesome Bellies to make advance commitments and payments to accommodation providers, transport operators, guides, restaurants, activity providers and other suppliers.

If you choose to cancel your booking, you must notify Wholesome Bellies in writing.

More than five months before departure

If you cancel more than five months before the scheduled Tour departure date, 50% of all monies paid to Wholesome Bellies as at the date of cancellation will be refunded.

Any non-refundable administration fees, credit card fees or payment processing fees already incurred may be deducted from the refund.

Between five and three months before departure

If you cancel between five months and three months before the scheduled Tour departure date, 25% of all monies paid to Wholesome Bellies as at the date of cancellation will be refunded.

Any non-refundable administration fees, credit card fees or payment processing fees already incurred may be deducted from the refund.

Three months or less before departure

If you cancel three months or less before the scheduled Tour departure date, no refund will be provided, subject always to any rights or remedies available to you under the Australian Consumer Law.

As significant Tour costs will generally have been committed or paid by this stage, we strongly recommend that every traveller obtains comprehensive travel insurance that provides appropriate cancellation cover.

No refund will ordinarily be provided where you arrive late, leave the Tour early, choose not to participate in an included activity or otherwise do not use part of the Tour where the relevant services remain available to you.


5. Transferring Your Place to Another Person

If you are unable to attend the Tour, you may nominate another person to take your place.

It is your responsibility to find a replacement traveller.

Any transfer is subject to approval by Wholesome Bellies and any requirements or restrictions imposed by our accommodation providers, transport operators or other suppliers.

Where a replacement traveller is approved, they may pay Wholesome Bellies directly for the value of your booking.

Once Wholesome Bellies has received the replacement traveller’s required payment in cleared funds, the payments you have made will be refunded to you in full, less any administration fees, payment processing fees, transfer fees or other reasonable costs incurred as a direct result of transferring the booking.

Where a supplier does not permit a booking to be transferred, or imposes an additional charge for doing so, Wholesome Bellies will advise you before the transfer is completed.


6. Travel Insurance

Comprehensive travel insurance is compulsory for every traveller.

Your travel insurance should be appropriate for your individual circumstances and the activities included in the Tour.

We strongly recommend that your policy includes appropriate cover for:

  • trip cancellation and interruption;

  • overseas medical and hospital expenses;

  • emergency evacuation and repatriation;

  • personal belongings;

  • travel delays and missed connections; and

  • the activities you intend to participate in during the Tour.

Travellers must provide proof of appropriate travel insurance to Wholesome Bellies before departure if requested.

Wholesome Bellies may decline to permit a traveller to join the Tour where the traveller has not obtained the required travel insurance.

Travel insurance is a separate contract between you and your insurer. Wholesome Bellies cannot guarantee that a particular loss, cancellation or event will be covered under your policy.


7. Flights & Travel to each Destination

Travellers are responsible for organising and paying for their own travel to and from Malaysia unless expressly stated otherwise in the Tour inclusions.

You are responsible for ensuring your flights and other travel arrangements allow sufficient time to arrive at the nominated Tour starting location at the required time.

Wholesome Bellies is not responsible for the cost or consequences of flight cancellations, missed flights, delays or other disruptions caused by airlines or other independent travel providers, except to the extent that liability cannot lawfully be excluded.

If you arrive after the Tour has commenced, any additional costs involved in meeting or rejoining the group will be your responsibility.


8. Passports, Visas & Entry Requirements

Each traveller is responsible for ensuring they hold a valid passport and satisfy all passport, visa, immigration, health and entry requirements applicable to their individual circumstances.

It is also your responsibility to check current government travel advice and entry requirements before departure.

Any costs arising because a traveller does not hold the appropriate travel documentation are the responsibility of that traveller.


9. Health, Fitness & Wellbeing

The Tour includes normal travel activities which may include walking, stairs, uneven surfaces, markets, nature walks, jungle walks, swimming, cooking experiences, boat travel and periods of transport between destinations.

You are responsible for assessing whether you are physically able to participate safely in the Tour.

Before departure, you must advise Wholesome Bellies of any health condition, mobility issue, allergy, injury, medical condition or other circumstance that may:

  • affect your ability to participate safely;

  • require special assistance;

  • affect another traveller; or

  • require specific arrangements during the Tour.

Where appropriate, travellers should seek their own medical advice before travelling.

Your health and wellbeing remain your responsibility throughout the Tour.

If Wholesome Bellies reasonably believes your participation in an activity may place your health or safety, or the health or safety of another person, at significant risk, we may ask you not to participate in that activity.


10. Dietary Requirements & Plant-Based Food

Food is at the heart of the Wholesome Bellies Malaysia experience.

The Tour will have a strong focus on plant-based food and the traditional and contemporary flavours of Malaysian cuisine.

Travellers must notify Wholesome Bellies before departure of any allergies, intolerances or specific dietary requirements.

We will make reasonable efforts to communicate these requirements to restaurants, hotels, cooking schools and other suppliers.

However, food is prepared by independent third-party suppliers, often in shared kitchens and food preparation areas. Wholesome Bellies cannot guarantee an entirely allergen-free environment or guarantee against cross-contamination.

Travellers with severe or life-threatening allergies remain responsible for taking appropriate personal precautions, carrying any required medication and obtaining relevant medical and travel advice before departure.

While the Tour is predominantly plant-based, in some destinations or circumstances the range of plant-based or specialist dietary choices may be more limited. We will always make reasonable efforts to accommodate dietary requirements wherever possible.


11. The Itinerary

The published itinerary represents our intended Tour experience.

Travel does not always run precisely to plan, and flexibility is sometimes part of the experience.

Wholesome Bellies may make reasonable changes to the order, timing, accommodation, restaurants, transport, activities or other elements of the itinerary where circumstances make this necessary or where we reasonably believe a change will improve the Tour experience.

Where practicable, we will endeavour to replace a materially changed activity, accommodation or experience with an alternative of a similar standard or character.

Minor itinerary changes do not automatically entitle a traveller to a refund.

Nothing in this clause limits any rights you may have under the Australian Consumer Law.


12. Third-Party Suppliers

Elements of the Tour are provided by independent third parties, which may include hotels, restaurants, guides, transport operators, activity providers, cooking schools and local tour operators.

These suppliers may have their own terms, conditions, operating requirements and safety procedures.

While Wholesome Bellies takes reasonable care when selecting suppliers, we do not directly control every aspect of services provided independently by those businesses.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.


13. Cancellation or Major Change by Wholesome Bellies

Wholesome Bellies reserves the right to cancel, postpone or materially change the Tour where reasonably necessary.

If Wholesome Bellies cancels the entire Tour and the Tour does not proceed, travellers will receive a full refund of monies paid directly to Wholesome Bellies for the Tour, subject to any additional rights available under the Australian Consumer Law.

Unless required by law, Wholesome Bellies will not be responsible for separately booked expenses that do not form part of the Tour price, including international or domestic airfares, independent accommodation, passport or visa expenses, vaccinations, travel insurance or other personal travel arrangements.

For this reason, comprehensive travel insurance is essential.


14. Events Beyond Our Control

Circumstances outside our reasonable control may include severe weather, natural disasters, fire, flood, epidemic or pandemic events, border restrictions, government action, civil unrest, industrial action, transport disruption or other extraordinary events that could not reasonably have been prevented.

If such an event affects the Tour, Wholesome Bellies may make reasonable changes to the itinerary or arrangements where necessary to protect travellers or enable the Tour to continue safely.

If the entire Tour must be cancelled, clause 13 will apply.

Nothing in this clause limits rights available to travellers under the Australian Consumer Law.


15. Personal Responsibility & Participation

International travel and participation in activities inevitably involve some degree of unpredictability and risk.

By joining the Tour, you acknowledge that activities such as walking, hiking, swimming, boat travel, road transport, cooking classes, markets and nature-based experiences involve ordinary travel and recreational risks.

You agree to follow reasonable safety instructions provided by Wholesome Bellies, Fiona and Lisa as Tour hosts, local guides, accommodation providers and activity operators.

You remain responsible for your personal decisions, behaviour, possessions and wellbeing during the Tour.

Nothing in these Terms is intended to exclude or limit liability where it would be unlawful to do so.


16. Behaviour & Group Experience

Wholesome Bellies is committed to creating a welcoming, inclusive, respectful and enjoyable small-group travel experience.

Travellers are expected to behave respectfully towards fellow travellers, Fiona and Lisa, local guides, suppliers, local communities and other people encountered during the Tour.

Wholesome Bellies may require a participant to leave the Tour where their behaviour is unlawful, seriously disruptive, threatening, abusive or creates a genuine risk to the health, safety or wellbeing of themselves or others.

Where a traveller is required to leave the Tour because of their own serious misconduct, any additional accommodation, transport or travel expenses will be their responsibility.

Any entitlement to a refund will be determined in accordance with these Terms and applicable law.


17. Personal Belongings

Travellers are responsible for keeping their passports, money, luggage, electronic devices and other personal belongings safe and secure.

We recommend using hotel safes where available and ensuring valuable belongings are appropriately insured.

Wholesome Bellies is not responsible for loss, theft or damage to personal belongings except where responsibility arises under applicable law.


18. Photography & Video

Part of the joy of travelling together is capturing the memories made along the way.

Photographs and video may be taken during the Tour by Wholesome Bellies, Fiona, Lisa or others travelling with the group.

Some of these images may be used by Wholesome Bellies for future website, social media, marketing or promotional purposes.

We respect every traveller’s preference.

If you do not wish to appear in promotional photographs or video, please advise Wholesome Bellies before departure or let Fiona or Lisa know during the Tour.


19. Privacy

Wholesome Bellies may collect personal information reasonably required to administer your booking and operate the Tour.

This may include contact details, emergency contact information, travel details, dietary requirements, allergies and health or accessibility information.

Where reasonably necessary, relevant information may be provided to hotels, restaurants, guides, transport operators, activity providers and other Tour suppliers for the purpose of operating your booking or accommodating your disclosed requirements.

Personal information will otherwise be handled in accordance with applicable privacy law and any Wholesome Bellies Privacy Policy.


20. Problems During the Tour

If you experience a problem or concern during the Tour, please tell Fiona or Lisa as soon as reasonably possible.

Giving us the opportunity to understand and address an issue while the Tour is underway will often allow us to resolve it quickly.

If the issue cannot be resolved during the Tour, please provide your complaint to Wholesome Bellies in writing following the Tour, together with enough information for us to investigate and respond appropriately.


21. Australian Consumer Law

These Terms & Conditions are intended to operate alongside, and not replace, your rights under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right, remedy or other protection that cannot lawfully be excluded, restricted or modified.

Where these Terms are inconsistent with a mandatory right or remedy available under Australian Consumer Law, that legal right or remedy will prevail.


22. Changes to These Terms

The Terms & Conditions applying to your booking are those provided or made available to you at the time your booking is accepted.

Any material amendment affecting an existing booking will be communicated to the affected traveller.


23. Governing Law

These Terms & Conditions are governed by the laws of the Australian State or Territory in which Wholesome Bellies Pty Ltd carries on its relevant business operations, together with applicable Commonwealth laws.

The parties submit to the jurisdiction of the courts and tribunals having lawful jurisdiction in relation to any dispute arising from these Terms.


24. Acceptance of These Terms

By paying your deposit or otherwise confirming your booking, you acknowledge that:

  • you have read and understood these Terms & Conditions;

  • you agree to be bound by them;

  • the information you have provided to Wholesome Bellies is accurate;

  • you understand your responsibility to obtain comprehensive travel insurance;

  • you understand the cancellation and transfer conditions applying to your booking;

  • you are responsible for ensuring you satisfy relevant passport, visa and entry requirements; and

  • you understand that international travel may occasionally require reasonable changes to the planned itinerary.
